Smoke Alarm Legislation

What is the Legislation?

The current legislation specifies that all Queensland dwellings to be leased or sold, must have interconnected photoelectric smoke alarms in all bedrooms, in hallways that connect bedrooms with the rest of the dwelling and on every level by 31st December 2021. From 1 January 2027, all Queensland dwellings must be compliant with the above legislation.

Gaining Access

Yes we will issue entry notices on behalf of the real estate agent to gain entry.
We will issue them via email if there is an email provided, otherwise we will send via Australia Post.

Faulty Alarms

No. When the Technician test Smoke Alarms, sometimes the alarm may beep for 10-15 minutes are the technician leaves. This is normal and does not mean that the alarm is faulty. It is part of resetting itself.

Insurances

Yes. We are fully covered and provide $20 million of insurance cover for Public Liability and Professional Indemnity.

Key Security

If a 1300 Technician attends a property and the keys do not work, they will call the tenants on file to see if they are available to gain access. If our technician cannot gain access, he will contact the office and advise that the keys provided did not open the door. The 1300 Scheduling team will advise the agency and reschedule when tenant is home or confirm the correct keys for next inspection.

If a key is to get stuck in a door, the technician will attempt to remove the key with WD-40. If the key cannot be freed, a call is made to the agency to meet the technician at the premises and attempt to remove the key.

Quote Approvals

If a Smoke Alarm is hardwired and needs to be replaced due to past expiry date or alarm fault, our technician will remove the head unit leaving only the 240V base. We will place a temporary 9V alarm in the location to ensure the property is Compliant until the quote is approved. If the technician is unable to secure the 9V alarm to the base of the hardwired alarm, the 9V alarm will be placed next to the hardwired alarm base.

Once the quote has been approved, our Electrician will attend the property to replace the hardwired alarm and remove the 9V temporary alarm.

If you do not approve our quote and have another electrician attend, the property will remain Non-Compliant until we have received the new alarm details from your Electrician. Once we receive this confirmation, we can make the property compliant in our system.
Yes. If you want replacements completed onsite for hardwired Smoke Alarms (if you are not on a FREE ALARM PACKAGE), we ask that you provide i9n writing a pre-approved repair amount that includes Safety Switch repairs also.
We will always leave the property safe for the tenants safety at all times before we leave.

Smoke Alarm Legislation

From 23 March 2020, all NSW landlords need to ensure that smoke alarms installed in a rented property must be in working order. A penalty will apply for landlords who fail to comply.

Smoke Alarm Legislation requires every smoke alarm in a rental property to have an annual maintenance service. Under this legislation, Landlords or agents must test and clean each smoke alarm annually.

Not only this, but each smoke alarm and battery must be replaced before the expiry date. The legislation prohibits the transfer of these responsibilities to the tenant.

Tenants

Tenant Obligations

You are required by law to replace, in accordance with the information statement (RTA Form 17a) provided to you, each battery that is flat or is almost flat during your tenancy.

Owners are required by law to install and maintain smoke alarms in your rental property in Queensland.

All smoke alarms must be photoelectric, hardwired or 10-year tamper proof battery powered and all interconnected by 31st December 2021. This will apply to all Queensland homes from 1 January 2027.

Smoke alarms must be installed on each storey plus :
»» in each bedroom; and
»» in hallways which connect bedrooms and the rest of the dwelling; or
»» if there is no hallway, between the bedrooms and other parts of the storey; and
»» if there are no bedrooms on a storey at least one smoke alarm must be installed in the most likely path of travel to exit the dwelling.

They must be tested and cleaned within 30 days before the start of a tenancy agreement.

In addition they must be replaced in accordance with the manufacturer’s instructions, each battery in the smoke alarm that is flat, or almost flat, within 30 days before the start of a tenancy.

The owner must replace smoke alarms when:
1. They reach 10 years after the date of manufacture; or
2. They do not work (including during a tenancy).

If you become aware that a smoke alarm in the rental property is not working, other than because the removable battery is flat or ‘chirping’, you must advise the landlord or agent as soon as practicable.

Smoke alarms make a warning ‘beep’ or chirp’ when there is a fault or when the battery is low.

The chirp may indicate the smoke alarm has become contaminated. Vacuum your smoke alarm with a soft brush attachment around the smoke alarm vents to remove any build-up of dust and cobwebs.

Use a surface insect spray around the smoke alarm to prevent insects from nesting inside it. Ensure you cover the smoke alarm while you spray to ensure you do not spray inside the smoke alarm.

Never paint over or cover your smoke alarms.

You can hush a beeping alarm by holding down the hush button for 3 seconds. This will generally silence the alarm for 10 minutes.

A licenced electrical contractor is required to disconnect or install mains powered smoke alarms.

Mains powered smoke alarms may give a low battery warning after periods of extended mains power outage. You should be aware of this once the mains power is restored.

After a technician has replaced a battery, the alarm may continue intermittently beeping for up to 15 minutes. This is normal.

If after changing the battery the smoke alarm continues to sound a warning ‘beep’ or ‘chirp’, the smoke alarm may be faulty and require replacement, so please contact your Property Manager.

If the smoke alarm is beeping irregularly, with no discernible pattern, it’s probably not the battery, it could be a spider or insects. If possible, remove the cover and blow out any cobwebs that has gathered there.

Another common cause of a smoke alarm beeping is a sharp variation in temperature and/or humidity. If the smoke alarm sits in an unconditioned part of your home like the top floor, it may be that in the winter, as the temperatures drops, the battery could became too cold to reliably deliver an electrical charge.

Yet another possible explanation could be ash, pollen, or dust that interrupts a small beam of light housed within the device, then even something as innocuous as an open window could be to blame. Consider cleaning the unit or close the closest window.

Sometimes, a smoke alarm beeps so loudly that even if the sound seems to be coming from one spot, it may really be emanating from somewhere else in the home. Please ensure you are looking at the correct smoke alarm.

If your hardwired smoke alarm is beeping and you have tried everything, you could try resetting the power which may solve the problem by resetting the device. If the alarm sounds a few times and then goes silent, that means it’s back to working order.

In Qld, your landlord is required to test and clean smoke alarms within 30 days prior to the start of a new tenancy or when a tenancy is renewed. If the property is managed by an agent, they may arrange for this to be done.
